Can the Employer require vaccination (against COVID-19)?

The employer is obliged to create a safe and healthy working environment and to take measures to prevent risks.

The employee, on the other hand, has the duty to take care of his/her own safety and health, as well as the safety and health of other persons at the workplace. This Employee’s obligation is also linked to the obligation to undergo the compulsory vaccinations stipulated by law.

However, at this moment there is no legal provision supporting the enforcement of the vaccination against COVID-19. Therefore, refusal to be vaccinated cannot constitute the grounds of any disciplinary action against the Employee, including dismissal.
