New methodology of imposing sanctions for breach of competition

The Office for the Protection of Competition has issued a new methodology concerning the sanctions for the breach of the Competition Protection Act, such as an execution of prohibited agreements, abuse of dominant position, anti-competitive conduct of public administration bodies or administrative infractions in concentration of competitors.

Although the powers of the OPC to impose sanctions remain unchanged, the rules for calculating the penalties are newly regulated. The rules have been created with respect to the application practice and in compliance with the conclusions of administrative courts, which deal with the issues concerned. The new regulation is more detailed and more precisely defines the powers of the OPC with respect to the imposition of sanctions for the breach of competition rules, which brings the competitors more legal surety.
