Specifics of incapacity for work and the right to a leave of absence for a member of a statutory body of a commercial corporation

Executive officers and members of the board of directors of corporations perform their duties personally and continuously and are obliged to act at all times with the so-called due managerial care. In contrast to employees, Czech law does not regulate the executive officer's sick leave and right to a leave of absence.

However, even an executive officer must sometimes take a rest and regain energy for the company management; besides, even an executive officer may fall ill, and not only at the time of the pandemics.

In a recent article for EPRAVO.CZ Magazine, attorney Milan Paták provides an overview of the specifics of a sick leave and the right to a leave of absence of a member of a statutory body of a business corporation, including recommendations on the content of the (managerial) contract to discharge office.
