Delivery and absence of a recipient

Do you spent your work time on longer business trips? Do you live someplace else but at your permanent residence address? If so, please make sure that you still receive documents mailed to you! In its resolution dated February 22, 2016, under case no. 20 Cdo 218/2016, the Supreme Court dealt with the conditions to pronounce ineffectiveness of the document’s delivery due to the absence of a recipient at his permanent residence address. In the case concerned, the recipient spent a half year on a business trip outside his permanent residence address. Although the court admitted that the business trip abroad or for example a hospital stay may constitute excusable grounds, a half-year absence at the permanent residence address should be handled by selecting another mailing address. Therefore, the ineffectiveness of delivery was not concluded.
